JMJ Woodworking Machinery reserves the right to change these terms and conditions at any time. Any such changes will take effect at the point of posting and it is your responsibility to read the terms and condition on each occasion that you use the site, your continued use of the website shall signify your acceptance to these latest terms and conditions.

Prices/Availability

Every endeavour is made to make sure all prices and information contained in this website are correct however errors may be made from time to time and therefore JMJ Woodworking Machinery disclaim all warranties and representation as to the accuracy of any such information. JMJ Woodworking Machinery cannot be held responsible for any loss or damage that may arise from the use of this information.

Orders are subject to manufacturer’s prices ruling at the date of despatch of the goods by the sellers and availability at the time the order is accepted.

All prices are quoted in British pounds sterling and subject to VAT at current rate.

All products purchased must be paid for in full prior to despatch/collection and remain the property of JMJ woodworking machinery Ltd until paid for in full.

Packing & Delivery

Packing and delivery charges will be charged extra unless otherwise stated. The seller may make part deliveries or may deliver any of the goods by instalments. The sellers will endeavour to adhere to the delivery date quoted but such delivery date is a business estimate only and the seller shall be under no liability whatsoever for delay in delivery or the consequences thereof howsoever caused.

Non Delivery & Damaged in Transit

In order to comply with statutory transport regulations claims for non delivery cannot be allowed unless notified to ourselves in writing within seven days from despatch date and for all damages in transit within three days from receipt of goods. Inspection of goods on delivery prior to signing acceptance is essential.

Storage

Where goods are ready for delivery the sellers may postpone delivery at the request of the purchaser provided that the purchaser pays the full price of the goods to the seller forthwith. The seller may store the goods at their own premises or elsewhere at the purchasers’ sole risk and all storage insurance and transport charges shall be paid by the purchaser.

Risk & property

Delivery shall be deemed to be made and risk in the goods shall pass to the purchaser at the time that the goods leave the seller’s premises. Property in the goods shall pass only on payment of the price.

Weight & Measures

Weights, measurements, horsepower etc. are approximate only and no guarantee is given or implied that the goods will conform. JMJ woodworking Machinery ltd reserves the right to amend specifications & withdraw goods from sale without prior notice.

Warranty

A) New Machines

The sellers will give the purchasers the benefit of any manufacturers guarantee or warranty relating to new machines.

B) Refurbished Machines

The sellers warrant that if any fault or defect due to bad workmanship or materials is provided within three months of delivery or within 1,000 working hours whichever shall be less than the sellers shall at their own cost repair or replace faulty or defective part or parts but subject as aforesaid all expressed or implied warranties and conditions whether statutory or otherwise as to qualify to fitness for any purpose of the goods are hereby expressly excluded.

C) Machines in Existing Condition

The sellers are not liable in any way for faults, shortage, errors, deficiencies or descriptions. The machines are sold with all faults, the purchaser buys at his own risk.

Cancellation

Cancellation on orders cannot be accepted without our written consent. Any deposits paid will not be returned.

Unloading

The buyer is responsible for unloading, site positioning, erection and any damage arising during these operations. No liability can be accepted for any work whatsoever for account unless agreed by us in writing.

Buyer’s Condition

Buyers order forms containing special printed conditions will be understood to be binding only when they are not at variance with our conditions of sales.

Liability

All liabilities and warranties or conditions statutory or otherwise as to quality or fitness or of any kind whatsoever as sellers or consignors including liability for any consequential loss, damage or injury or for loss, damage or delay in transit are hereby expressly excluded. Any liability or ours of any kind whatsoever as sellers or consignors is strictly limited to the terms of the warranty set out above. Any liability on our part is subject to the terms of payment and all the customer’s other obligations being strictly observed.

Health and Safety

It is the buyers responsibility to carry out risk assessments to ensure the machine/s supplied are safe and without risk to health and safety prior to use.

PUWER (Provision & Use of work equipment regulations 1992) under these regulations it is the employers/buyers responsibility to ensure that machinery is suitably guarded, efficiently maintained and in a good state of repair.

Training - all machine operators must have received sufficient training and instruction in safe operation of the machines (Woodworking Machinery regulations 1974) it is the employers/buyers responsibility to make sure all employees are suitably trained.

Noise – The levels of noise produced by machines varies considerably It is the responsibility of the buyers responsibility to ensure machines operate within the current noise legislation.

Dust – Wood dust can be harmful to health under the hazardous substance regulations it is the responsibility of the employer to ensure machines operate within the current dust legislation.
